Position Summary:

The By-law Enforcement Officer is responsible for ensuring compliance with municipal by-laws, provincial regulations, and relevant legislation. As per the Towns and Local Service District Act Section, 278, A by-law enforcement officer has the powers, duties and functions that are prescribed in this Act or as determined by a town council by by-law. This role combines by-law enforcement and inspection duties, requiring the officer to investigate, inspect, and resolve potential violations while promoting public safety and regulatory adherence.

Key Responsibilities

  • Enforce municipal by-laws as prescribed by legislation or council resolutions.
  • Investigate complaints and suspected violations of municipal by-laws.
  • Issue orders for compliance, specifying timeframes for resolution when required.
  • Maintain accurate records of enforcement actions and investigations.
  • Act with professionalism and impartiality, ensuring community members are treated fairly.
  • Issue warnings and tickets.
  • Inspect premises, equipment, processes, or records as required to determine compliance with municipal by-laws, regulations, or legislation.
  • Examine and copy records, photographs, or other relevant evidence as necessary.
  • Require assistance from owners or persons in charge of premises to facilitate inspections.
  • Obtain and execute inspection warrants, including tele warrants, when necessary for suspected offences.
  • Ensure all inspections comply with legal requirements, including limitations on entering dwellings without consent.
  • Administer the Town’s Municipal Plan, Development Regulations, and zoning by-laws.
  • Review, evaluate, and process applications for development, rezoning, variances, and permits.
  • Provide professional planning advice and recommendations to Council, committees, and staff.
  • Conduct site inspections to ensure compliance with approved development and land use policies.
  • Assist in the preparation and implementation of community and economic development plans.
  • Liaise with developers, contractors, provincial/federal agencies, and the public on planning matters.
  • Monitor community growth trends and prepare reports or recommendations on zoning and land use updates.
  • Draft amendments to by-laws, development regulations, and planning policies.
  • Prepare reports, correspondence, and presentations for Council meetings.
  • Maintain accurate records of enforcement activities, applications, permits, and approvals.
  • Support public consultation and community engagement processes related to planning and development.
  • Uphold integrity, transparency, and ethical standards in all enforcement, inspection, and planning activities.
  • Act impartially and professionally in interactions with the public and other stakeholders.
  • Maintain confidentiality and handle sensitive information appropriately.

Qualifications

  • Post-secondary education in law enforcement, public administration, planning, or a related field and/or a combination of education and experience may be considered.
  • Knowledge of municipal by-laws, provincial legislation, zoning, and regulatory frameworks.
  • Strong investigative, analytical, and problem-solving skills.
  • Excellent communication, conflict resolution, and interpersonal skills.
  • Ability to work independently and make sound decisions in the public interest.
  • Valid driver’s license and ability to travel within the municipality.

Working Conditions:

  • Combination of office and fieldwork, including inspections, investigations, and site visits.
  • May require evening or weekend work to respond to complaints or enforcement matters.
  • Exposure to varied environmental conditions and potentially challenging public interactions.

Salary

As per the Union Agreement with CUPE Local 1761.
